Administrative principle by legislative bill is law principle that lawfulness and reasonableness of administration have to insurance. At the same time, administrative power have to observe the law and is attached to rule, if administrative power have damaged to the citizen, relief system by trial is prepared.
In this manuscript, I wanted to present the desirable soultion to appraise how the base and limit of administrative-legislation for harmony with administrative principle by the law and Standsrds of Discretion of control means of discretion operate by administrative-legislation type.
Although the Supreme Court render disposal standard of dispensing order to prescribe president order according to the provisions legal order, it doesn't mean controling function of discretion of Standsrds of Discretion by regarding disposal standard mandated to prescribe being administrative order as administrative rule.
This is helped concrete logicality of administration. However, it results that legal stabilization regard to the prediction possibility of administration can't raise.
In conclusion, the Supreme Court has to pay regard to the point, exclusion of the legal function of discretion control by the administration legislation without rational reasons, within the scope of a legal limitation of the administration legislation, is the no authority making(or creating) of the judicial officer law beyond the range of the interpretation or application of law.
