This research aims to study legislative reform policies of drug demand reduction and treatment system for drug offenders in Korea.
Firstly, it studies the principles and strategies for an effective legislative policy on drug control. Secondly, theories on effective legislation is to be studied for a more effective and fair drug control system. Thirdly, a primary, secondly and tertiary crime prevention model will be applied to devise a drug crime prevention programmes.
After that, national drug control policies of the US and EU countries will be analysed from the standpoint of legislative policy, which leads to the legislative proposals on the reform of drug demand reduction and treatment system.
Legislative policy on drug control should be established on the National Drug Control Strategy, and furthermore it has to consider constantly changing situation of drug problem. Current drug control system has relied on criminal sanctions, and faces criticism that it has failed to reduce drug demand and to provide effective treatment. Cooperation between criminal justice system and public health care system in dealing with drug problem is to be discussed as a new paradigm of drug control. Comparative studies of US and EU drug policy confirms that the alternative system would be effective policy of drug control.
As legislation is a communicative process, making drug laws demand civil participation, which would guarantee more effective and respected drug laws in our society. However, as seen at the debates on the 'decriminaliztion' of marijuana, there strongly needs rational policy on the issue ; public opinion may distort legislative process.
As for treatment programme for drug offenders, proper evaluation and supervisory system, as well as funding should be prepared. Policy-makers should aware that an effective treatment system would not merely a problem of fund or human resources, but a question of new paradigm of 'More Treatment and Less Punishment'. To put this policy ideas into practice, more legislative programmes should be needed for cooperative system of criminal sanction and treatment for drug offenders.
