1. The research aims to study control policies of drugs for medical use in Korea. Firstly, it analyses the situation of crimes related to drugs control in medical facilities. After that, the problems of current system for controlling narcotics for medical use will be researched, which leads to the strategic proposals on the reform of both criminal and administrative system in the matters of drug control in medical facilities.
2. The objective of the medical narcotics control is to provide drugs for medical use and to prevent abuse of drugs. As the harms of drugs abuse is so serious that drugs for any purposes have to be tightly controlled both by criminal and administrative sanctions. On the other hand, as medical drugs are dealt by medical and pharmaceutical experts, some autonomous control system would be allowed. Thus, in the general context of the National Drugs Control Strategy, the criminal sanctions and administrative regulation on medical narcotics should be re-balanced for a more effective control system.
3. The first chapter overviews the objectives and issues of the research.
The second and third chapter analyses the situation of crimes, which violate regulations on narcotics for medical use and the practice of medical narcotics control systems.
The fourth chapter is for a comparative research on the control legislation and systems of medical narcotics in the UN, USA, and Japan
The fifth chapter deals with specific issues of legal policy, including legislative demands of reforming criminal and administrative sanctions on the violations of rules on medical narcotics.
4. The last chapter considers legislative policy for the effective and practical control system of narcotics for medical use. A legislative proposal of the ‘Bill on the Control of Psychotropic Substances for Medical Use’ will be reviewed. The Bill of 2006, prepared by Professor S.Lee and National Assemblyman H.Jung is to separate the control of medical narcotics from the uniform legislation of illegal drugs control, the Act of Drugs Control in 2000.
5. The Bill proposes the establishment of Control Committee under the Korea Drug & Food Administration(KFDA), which is the main government authority in safety control on drugs. The Committee will provide guidelines on the management and use of medical drugs. To avoid the over-criminalisation in medical narcotics control, and to promote autonomous control by medical experts themselves, the Bill introduces a special report and sanction system under the KFDA, and medical experts inspectors who supervise the drugs control in medical facilities.
6. Surely, the matters of over-criminalisation in medical narcotics control must be considered from the rational criminal justice and effective administrative regulation. However, the control of drugs for medical use is a part of the National Drug Control Strategy, which demands systematic and strict control of drugs. Policy-makers should consider that loosen control in medical narcotics would result ‘loophole’ in combating against illegal drugs in our society.
