Brazil has amended labor law called CLT in 2017. The content of the reform significantly reflects the necessity of the Brazilian society which requires flexibility, such as homeoffice and intermittent work. Uber business is one of the emerging industry 4.0 based on shared economy. Uber is, by itself, a technology company that provides digital platforms, but its profit structure has many characteristics of transportation company that use uber drivers. Therefore, courts around the world are showing various different positions regarding the employee status of the uber driver. This paper outlines the contents of the revised Brazilian Labor Law in response to the Fourth Industrial Revolution. Reviewing Uber-related labor lawsuits around world, the paper will look at how the Brazilian courts are applying the revised labor law to Uber drivers. Finally, the paper will criticize the attitude of the Brazilian labor courts on the industry 4.0.
