The purpose of this study is to craft possible resolutions for the sunset provision of long-term unexecuted urban planning facilities. In this study, legal system and government policy related to the urban planning sunset system were first examined, and the status quo and management conditions of long-term unexecuted urban planning facilities were analyzed. Upon the analyses, this research identifies the problems and agendas of sunset provision of the long-term unexecuted urban planning facilities, and propose the responsive strategies.
In 2000, urban planning facility sunset clause was introduced through the amendment of the Urban Planning Act. If implemented, sunset clause of urban planning facilities nullifies the proposed project of the facilities of which the installment did not take place for 20 years since the planning(designation and determination).
As of December 31, 2017, 13,749 urban planning facilities have not been installed for over 10 years since the planning, 102.3㎢ area-wise, and presumably the total cost of implementing the long-term unexecuted urban planning facilities reaches 33.3 trillion won.
Out of the facilities, 4,647 urban planning facilities with the area of 56.7㎢ were not installed for 20 or more years after the determination, and will lose effect by July 2020. This amounts to 33.8% of the total number of long-term unexecuted facilities, and 55.4% of the total area. Estimated project cost to implement the facilities is about 13 trillion won, which accounts for 40% of total project cost.
Among the long-term unexecuted urban planning facilities, roads have the highest percentage of numbers of facilities that are subject to validation due to more than 20 years of nonenforcement: 4,067 out of 10,329 long-term unexecuted roads are lost effect, reaching 39.4%. Parks have the largest target area: 30.3㎢ out of 41.2㎢ long-term unexplored parks are targeted for validation, which accounts for 76.3%. Also, parks have the highest enforcement cost: the projected cost is 4,817.2 billion won, which is 51.6% of the total project cost of 9,332.7 billion won for the long-term uncovered parks.
The authority of Gyeonggi provincial Government to directly manage long-term unexecuted urban planning facilities is limited, since the control for the installation and management of urban planning facilities is delegated to the municipal governments. However, provincial Government needs to provide administrative․ financial support to ensure smooth implementation of the long-term unexecuted urban planning facilities and the sunset provision.
It is necessary to amend the law and improve the system secure the supply of funds from Development Charges and Regional Development Fund. Moreover, the City Planning Commission needs to revise the standards of the Urban Planning Committee and establish guidelines for installing and dismantling the long-term unexecuted urban planning facilities.
