Dramatic advances in science and technology, significantly stimulated by the Human Genome Project, have led to remarkable progress in molecular genetics. But those advances have raised deep social concerns about the acquisition, protection, and use of genetic information.
Each individuals' genome is unique to them. So if human tissues are found at a crime scene, the genetic material they contain can be used to identify who was present at the site if a matching sample can be obtained from an individual or from a database - DNA databanks. These databanks are repositories of genetic information about individuals obtained from the analysis of DNA samples.
DNA databanks can be used for a variety of purposes. Although DNA tissue and data banking had their inception in the context of clinical medicine and medical research, today the main use of the technology is occurring in the forensics context. Having a reference DNA profile on file for everyone in the population could remarkably increase crime resolution rates, especially in serial sex crime cases. But a population-wide DNA data bank could be a 'Big Brother' in this technology era.
Therefore the public debate and the enactment is indispensable for the acquisition and use of genetic information. In Korea, a legislative bill about bioethics, which includes the regulations about genetic information, is enacted in 2004. But there is no regulation about the DNA Databank for Criminal Investigation. Genetics is important, but its importance should not be overstated. And the legislation which regulates the DNA databank for criminal investigation strictly must be enacted as soon as possible.
