There is positive view point about DNA databases; it is said that DNA database is effective mean to solve violent cirmes or sex crimes which have high rate of recidivism generally and motive less crime in that case, criminals usually select victims or targets indiscriminatively, with no aims. over there, it is a useful investigative method to solve cold cases(unsolved criminal cases), to prevent crimes.
In fact, there were many cases of DNA dragnet(DNA mass-screening) in police investigation in Korea, too. so in this reason and social need for effective law enforcement, the introduction of DNA databases & legislative system has been proposed in Korea from early 1990s.
Now, DNA databases have been operated as criminal investigative method in United Staes(CODIS, combined DNA index system), United Kingdom(NDNAD), Germany, other many countries. in Korea, there was a attempt to introduce DNA databases in 1994 by national police agency and prosecutorial office. and in 2005, new legislative system of DNA databases has been introduced by cooperation of the national police agency & prosecutorial office, again.
In relation to DNA databases & legislation, many problems are proposed like this; ① wrongful invasion of privacy in relation with genetic information of individuals, ② unjustice discriminative restriction by country with DNA information etc. and so in details, there are much of debate about kinds of databased crimes, criminals, time to sampling DNA, method of sampling, possibility of deletion of databased information, managing of DNA samples, and so on.
In this study, in relation with the introduction of DNA databases in korea, it is a main object to analyzed Korean DNA databases & legislative system and proposed appropriate model of DNA databases in korea, comparing with United States, and the other country's examples, related law cases.
