These days administration is going to be stronger and bigger than before in modern states. Peoples' complaints to administrative agency on conflicts between public interests and individual interests are rapidly increasing in our country. There is a lot of methods to protect people by correcting any wrong and illegal administrative agency's actions. For example, there are administrative procedure, petitions to assembly, ombudsman, administrative litigation, compensation by administrative agency and etc.
I aims to study in this article on the resolution system of peoples' complaints originally derived from the Swedish system named “Ombudsman” as a administrative remedies without litigation in Korea like Gochungcheoliwiwonwhi, National Human Rights Commission, Korea Independent Commission against Corruption and etc. I think that they function as a kind of so-called Alternative Dispute Resolutions(ADR) in Korea. The national ombudsman named Gookmingochungcheoliwiwonwhi is operating for all nationwide peoples, whereas the local ombudsman named Shimingochungcheoliwiwonwhi is operating for regional residents.
The latter is narrower than the former in jurisdiction. The latter's jurisdiction is limited to its ruling region while that of the former is nationwide. They are also applied by the same law of July 29, 2005.
However there is a discrimination between the latter and the former in organization, membership, term of membership, reappointment possibility and so on.
It is at issue that the latter is at local self-government's discretion in its establishment. In a word it is optional institution. So that the latter couldn't and won't fulfill its function appropriately now.
For that reason it is necessary to revise the above-mentioned law to improve that system. The latter is also to be compulsorily established by law as like the former. That's a short way to vitalize the latter for the regional residents. If not, the opinion that it is necessary to integrate some similar ombudsman institutions like National Human Rights Commission will be persuasive.
