Present state and problems concerning Business Model patents are described. Software exists apart from hardware and its value lies not in the media on which it is recorded but in the described information. Business Model, however, is not simply information but it possesses technical characteristics that have a direct influence on hardware, namely computers. This special trait has now given rise to questions about the nature of Business ModeHsoftware) patents. In addition, the fact that copying software is extremely easy mat greatly facilitate the so-called "production" activities in the Patent Law. Furthermore, because the information itself has independent value, sometimes the software information alone is taken and distributed through networks instead of via recording media. This is a point where serious questions about the effectiveness of Business Model patents have arisen.
For example, the patent law is defining invention as the thing "that a level is high as a creation of the technical thoughts that used the law of nature" on configuration of invention during a patent requirement. Also, "the invention which they can use in industry" is the patent object and is defining in the patent law. Meaning of technology is a concrete means to achieve a regular purpose, and it can be interpreted what they can actually use here. They examine whether it is all enough by configuration of business model related invention, and this must determine.
