This study analyzeds the moral meaning of ‘Quan(權)’ from a new perspective through the process in which the concept of ‘Quan’ was raised in Mencius’ moral philosophy. In the existing studies, Mencius’ ‘Quan’ is generally contrasted with ‘Li(禮)’ or ‘Jing(經)’ as an immutable moral rule that must be observed in general everyday situations and it is used as a criterion for recognizing means and methods capable of ad hoc adaptation in a special situation, and is regarded as an instrumental value for decision-making. However, if we understand Mencius’ moral theory and the process in which the concept of ‘Quan’ was mentioned, the concept of ‘Quan’ itself has the essential value of morality exercised in accordance with the situation when the moral mind is at hand, and the concept of ‘Dao(道)’ coincide with the spirit. And it creates rules of moral behavior as instrumental values that morally respond to and deal with various situations in reality while having moral autonomy in which the mind, the subject of moral practice, operates voluntarily and autonomously according to its moral commands.
In addition, Mencius’ ‘Quan’ is not a criterion for moral judgment and action decisions of ordinary people who are morally imperfect, but the ability to realize morality that is equipped with a person of moral character. Since ordinary people do not have the spirit of ‘Dao’ perfectly and regard ‘Quan’ as a means to justify their own and collective actions, they cannot fully realize the essential value of ‘Quan’. Only the person of moral character, that is, the saint can exercise ‘Quan’ as an essential value. For this reason, the saint does not have a moral dilemma in any situation and can respond appropriately to the situation. This is the saint’s ‘Quan’.

본문은 맹자의 도덕철학에서 ‘권(權)’ 개념이 제기된 배경과 그 맥락을 통해 기존의 시각과 다른 시각으로 ‘권’의 도덕적 의미를 분석한 연구이다. 기존의 연구에서는 대체로 맹자의 ‘권’을 일반적 상황에서 반드시 지켜야 하는 불변의 상법(常法)으로서 ‘예(禮)’ 또는 ‘경(經)’과 대비되고, 특수적 상황에서 임기응변할 수 있는 변칙적인 편법의 수단 및 방법을 인정하는 판단 기준으로 활용되는 행위 결정의 도구적(수단적) 가치로 여긴다. 하지만, 맹자의 도덕 이론과 ‘권’ 개념이 언급된 배경 및 그 맥락을 파악하면, ‘권’ 개념은 그 자체로 도덕적 마음이 항상 그 당면한 상황에 부합하게 발휘된 도덕의 본질적 가치를 갖고 있으며, ‘도(道)’의 정신과 일치한다. 그리고 그것은 도덕 실천 주체인 마음이 자기의 도덕 명령에 따라 자발적이면서 자율적으로 작동하는 도덕 자율성을 갖추면서 현실의 다양한 상황에 대응 및 대처하는 수단적 가치로서 도덕 행위의 규칙을 창조해낸다. 아울러, 맹자의 ‘권’은 도덕적으로 불완전한 일반인의 도덕적 판단 및 행위 결정을 위한 기준이 아니라, 도덕 인격자에게 갖추어진 도덕 실현의 능력이다. 일반인은 ‘도’의 정신을 완벽하게 갖추지 않고서 ‘권’을 자신과 집단의 행동을 정당화하는 수단적 가치로 여기기 때문에, ‘권’의 본질적 가치를 온전히 실현할 수 없다. 도덕 인격자, 즉 성인이야말로 진정한 본질적 가치의 ‘권’을 실현할 수 있는데, 도덕적 딜레마와 같은 특수 또는 특정 상황에서도 도덕적 딜레마가 발생하지 않고 그 상황에 부합하는 적절한 대응을 할 수 있다. 이것이 바로 성인의 도덕 실현 능력인 ‘권’의 작동이다.
