Electronic waste(e-waste) causes heavy metal contamination, but recycling and environmental treatment are essential because useful resources can be recovered. However, the amount of e-waste generated is increasing every year, which is recognized as a serious environmental problem.
Meanwhile, electronic products can only be repaired in places directly operated or certified by manufacturers, and repairs through professional repair companies are impossible at all or excluded from quality guarantees. Accordingly, in order to extend the life of electronic products and expand consumer rights, the need for the right to repair and use electronic products is being discussed.
The European Union and the United States are obligated to provide spare parts and have the right to repair them by providing repair-related information to consumers and professional repair companies. Some countries do not view the use of design for repair as an infringement of design rights. In Korea, an amendment to the Mobile Device Distribution Improvement Act and a Act on the Right to Repair have been proposed to the National Assembly, and the right to repair is being discussed.
The realization of the right to repair is related to expanding the scope of producer responsibility from the design stage to consider environmental factors, operating quality guarantees, protecting intellectual property rights for parts or products, and providing necessary information for repair. The right to repair has problems that require adjustment in relation to the existing economic system or legal system. However, repair access to electronic products must be strengthened, and the right to repair in the true sense can be implemented as consumption that takes into account the perspective of resource circulation.

전자폐기물은 중금속 오염을 유발하지만 유용한 자원의 회수도 가능하여 재활용과 환경적인 처리가 필수적이지만, 발생량은 지속적으로 증가하고 있어 심각한 환경문제로 인식된다. 한편 전자제품은 제조 업체가 직접 운영하거나 인정한 곳에서만 수리할 수 있고, 전문 수리 업체를 통한 수리는 아예 불가능하거나 수리 시 품질보증 대상에서 제외하고 있다. 이에 전자제품의 수명을 연장하고 소비자 권리를 확대하기 위해 소비자가 스스로 전자제품을 수리하여 사용할 수 있도록 하는 수리할 권리(right to repair)의 필요성이 논의되고 있다.
유럽연합과 미국에서는 예비 부품 제공을 의무화하고, 소비자와 전문 수리 업체에게 수리 관련 정보를 제공하는 방식으로 수리할 권리가 실현되고 있으며, 일부 국가는 수리 목적의 디자인 실시를 디자인권 침해로 보지 않는 방식으로 운영하고 있다. 우리나라에서도 이동통신단말장치 유통구조 개선에 관한 법률 개정안과 수리할 권리에 관한 법률안이 국회에 발의되어, 수리할 권리에 대한 논의가 본격적으로 진행되고 있다.
수리할 권리의 보장은 폐기물 발생량의 저감, 소비자 권리의 확대 측면에서 도입 필요성이 인정되지만, 품질보증 법제와 상충될 수 있다. 또한 설계 단계부터 환경적 요소를 고려하도록 생산자 책임의 범위 확대, 자가 또는 제3자의 수리 시 품질보증 기간이나 내구연한의 변경, 부품이나 제품에 대한 지식재산권 보호, 수리에 필요한 정보 제공의 범위 등도 문제된다. 수리할 권리는 기존의 경제시스템이나 법체계와의 관계에서 조정이 필요한 문제들이 있지만 전자제품에 대한 수리 접근성은 강화되어야 하며, 진정한 의미의 수리할 권리는 자원순환의 관점을 고려한 소비를 통해서만 구현될 수 있다.
