Many people call the Republic of Korea the Republic of apartment house. This expression shows how many apartment houses are built in Korea. Also, according to findings by Statistics Korea, in 2019, people in the lower income bracket live more in single-family housing than in multi-family housing, whereas people in the higher income bracket live more in multi-family housing than in single-family housing.
Even if interpreting the AOMC to promote the people’s benefit who live in multi-family housing, the Korean court should interpret the AOMC in the light of the whole legal system. If not doing so, sprung-up-everywhere large-scale apartment complexes could spoil the landscape, and a wealth gap between the rich and the poor could be more serious.
This Article examines several major decisions of the Korean court on the right of using site, in that in particular, in Korea, many people are very interested in land as limited resources, and nevertheless, there is just a short direct description of the right to use site in the AOMC Section 3 which consists of only three provisions.
When it comes to condominium building, among other things, a section for exclusive use and the right of using site for it should be treated as a whole. If not so, the site owner could require the sectional owner who has no right of using site to remove his or her section for exclusive use by exercising real action on the site ownership. However, in most cases, it is almost impossible to remove only the section for exclusive use concerned. In this respect, there is surely some doubt about several major decisions of the Korean court on the right of using site.
