There is recently a movement to revise the Administrative Litigation Act, governing administrative litigation procedure in Korea. There are four different types in Korean administrative litigation such as appeal litigation, party litigation, public litigation, and agency litigation. According to the Act, the appeal litigation is subdivided into revocation litigation, litigation for affirmation of nullity, and litigation for affirmation of illegal non-feasance. It mainly deals with not administrative rule-making but administrative disposition. The judicial review of administrative rule-making is very important in a modern society. The legislative power is vested in the Congress, but may be delegated to the executive branch with some limitation in modern democracy. There is no administrative rule-making provisions in the U.S Constitution, but the administrative rule-making has been very prevalent since the Depression. The daily life of the people is mostly affected by the administrative rule-making, and the judicial review of administrative rule-making is well-established in the U.S. The Court allows the pre-enforcement judicial review of administrative rule-making in the U.S., the affected party has a chance to challenge the administrative rule-making at early stage. Koreans need to reconsider advantages of the pre-enforcement judicial review of administrative rule- making to save the predicament of the affected party when they revise the Administrative Litigation Act.
