The Article 46 of the Korean Private International Law on the maintenance obligations is the product of accepting the main content of the Hague Convention of 1973 on the Applicable Law to Maintenance Obligations. In 2007 the Hague Conference on Private International Law has newly made the Hague Protocol of 2007 on the Law Applicable to Maintenance Obligations for the purpose of replacing the Hague Convention of 1973 on the Applicable Law to Maintenance Obligations. It was because the Hague Convention of 1973 on the Applicable Law to Maintenance Obligations had many problems and was out of date.
Overall, the Hague Protocol of 2007 on the Law Applicable to Maintenance Obligations is evaluated positively. Therefore I recommend the Korean Government to ratify it. Otherwise, the Article 46 of the Korean Private International Law on the maintenance obligations needs to be amended according to the main content of the Hague Protocol of 2007 on the Law Applicable to Maintenance Obligations.
Overall, the Hague Protocol of 2007 on the Law Applicable to Maintenance Obligations is evaluated positively. Therefore I recommend the Korean Government to ratify it.
