The constitutional court shall have jurisdiction over the constitutional complaint. Constitutional complaint can be filed with the Constitutional Court by any person who believes his or her fundamental rights guaranteed by the Constitution have been breached due to the exerciseor non-exercise of government power. Constitutional Court Act Article 68-1 provides that Any person who claims that his basic right which is guaranteed by the Constitution has been violated by an exercise or non-exercise of governmental power, except the judgments of the ordinary courts, may file a constitutional complaint to the Constitutional Court : provided, that if any relief process is provided by other laws, no one may file a constitutional complaint without having exhausted all such processes. Constitutional complaint is needed in order to perform its subjective function of protecting fundamental rights and to fulfill its objective function of clarifying constitutional issues as well. The effectiveness and faith of constitutional adjudication can ultimately be guaranteed by the persuasiveness of the argumentations which lie within the reasons of its decision. The judgements of the Court convince other state authorities and promote people's trust.
