Nowadays, the seriousness of North Korean human rights situation has been continuously increased. Indeed, the North Korean problem comprises the peace problem, nuclear problem and human rights problem, however, human rights problem is of the greatest importance and should be settled firstly. North Korean human rights problem is to be regarded as not just North Korean domestic matter or inter-Korean problem, but an international matter or a matter of international concern.
Recently, international community concentrates its focus on the North Korean human rights situation. UN Human Rights Council(HRC) and General Assembly(GA) adopted the North Korean Human Rights Resolutions that reveal the cases and evidences of the grave, systematic and widespread violations of human rights within and by North Korea. In these resolutions, it is strongly recommended that UN Security Council(SC) should refer the North Korean human rights situation to the international criminal justice mechanism including the ICC and review the effective method of implementing targeted sanctions against North Korean high-ranked officials who are responsible for the exacerbated human rights situation and committed the crimes against humanity.
Since 2001, the Responsibility to Protect(R2P) was conceptualized in relation to the concept of "human security" and has developed into international norm or at least "soft law" through the reports and resolutions of the ICISS and UN principal organs, such as GA, SC and Secretary-General. Principle of R2P prescribes the obligations or responsibility to prevent and respond to human rights catastrophes. Firstly, international community including the UN, as a subject of R2P should endeavor to improve severe situations of North Korean human rights through the implementing the responsibility to prevent.
In case of the manifest failure of the individual State to implementing its own R2P, the international community should start to implement the R2P focused on the responsibility to react and rebuild. In relation to R2P of the international community, the UN has the responsibility to react and make timely and decisive means including coercive measure in accordance with the Chapter 7 of the Charter. It is suggested that the role of the UN through SC has to be strengthened, therefore, the role and method of SC for the implementation of R2P in relation to the settlement of North Korean human rights problem should be improved and reviewed.

최근 북한 인권상황이 그 심각성을 더해 가면서 유엔을 중심으로 한 국제공동체의 관심이 집중되고 있다. 북한 인권문제는 분단체제 및 남북대치라고 하는 한반도 상황과도 밀접한 관련성을 맺고 있는 것이 사실이지만, 인권문제는 그 자체로 해결되어야만 하는 중요성을 가지고 있는 것이다. 인권문제의 당사자인 북한 당국과 함께 분단체제의 일방당사자인 한국(남한)의 역할도 매우 중요한 요소를 지니고 있지만, 여기서는 인권문제의 보편성을 기초로 국제공동체가 접근방법으로 채택하고 있는 R2P의 관점에서 북한 인권문제 해결의 가능성과 그 방법에 관하여 검토하였다.
북한 인권상황에 대한 인식은 논자에 따라 다양하게 이루어지고 있는 것이 사실이다. 그러나 유엔은 북한인권 COI의 보고서를 토대로 R2P의 제 1 기둥의 주체인 북한 당국의 책임이행이 실패로 귀결되었거나 그 의지가 없다는 결론을 내리고 있다. 그리고 유엔은 국제공동체에 부과된 제 2 기둥에 따른 책임을 이행했다는 점을 전제로 하여 제 3 기둥에 속한 대응책임의 이행에도 착수한 것으로 보인다. 보인다. 유엔은 HRC와 총회의 북한인권결의를 통하여 북한에서 오랫동안 자행되어 온 극심한 인권침해의 결과 ‘인도에 반하는 죄’를 구성하기에 이르렀음을 확인하고 이를 근거로, “인도에 반하는 죄로부터 북한 주민들을 보호할 책임을 이행하지 못한 책임자들에 대한 제재와 함께 북한의 상황을 ICC에 회부하는 절차를 적극적으로 추진하고 있다.
북한의 현 상황은 R2P와 관련하여 국제공동체 차원의 ‘예방책임’과 ‘대응책임’이 동시에 이행되어야만 하는 경우에 해당한다. 유엔이 책임 있는 당사자들을 인도에 반하는 범죄자로 처벌하거나 제재를 가하도록 결정함으로써 유엔이 일종의 대응책임을 이행하기 시작했다고 할 수 있을 것이다. 그러나 이러한 조치는 이를 통하여 북한 내에 민주적인 정권을 수립할 수 있도록 지원하는 의미를 갖는 것이기도 하기 때문에 일종의 체제전
환을 통한 문제해결을 시도하는 것으로 예방책임의 이행에 해당한다고 볼 수도 있는 것이다.
문제는 이러한 평화적인 방법으로 사태 해결이 불가능한 상황에 봉착하는 것이다. 모든 평화적인 수단을 동원하여서도 문제가 해결되지 않는 경우 R2P 원칙에 따르면 강제조치를 포함한 시의적절하고 단호한 조치를 취할 수 있으며 또한 최후의 수단으로서 ‘무력사용’을 통한 해결도 고려할 수 있도록 되어 있다. 그러나 무력사용을 통한 문제의 해결은 북한 내부에서 내전이 발생하거나 정권의 붕괴로 인한 급변사태(국가실패)의 경우가 아닌 한 상정하기 어려운 방안이 될 것이다.
