In Korea, the Convention on the Rights of Persons with Disabilities has taken effect on the 1st of October, 2009, since Korea became a member of it on the 2nd of December, 2008. This led Korea to submit the report in relation to Section 35 of Convention on the Right of Persons with Disabilities to UN Committee on the Rights of Persons with Disabilities on July, 2011, and the concluding observations were received on the 30th of September, 2014. The adult guardianship system has taken effect on the 1st of July, 2013 in Korea before we have the concluding observations of the Convention on the Rights of Persons with Disabilities.
According to the concluding observations of UN Committee of the Rights of Persons with Disabilities, they have been concerned that the Korea adult guardianship system substitutes for a ward about his/her assets and his/her personal affairs. They have called Korea to switch the adult guardianship system from “the supported decisionmaking” to “the substituted decision-making. In such a circumstance, it is very difficult to find the way to switch the Korea adult guardianship system to “the supported decision-making”. For this, this article has reviewed the English adult guardian system. The English Mental Capacity Act requires that all people have their decision-making competence and has been supporting those who do not have ability to make a decision. If the supported decision-making could not be done practically, even if such support has been maximized, for people who lack capacity was left open the possibility of the substituted decision-making through the way of the best interests according with strict requirements.
The “supported decision-making” of the English Mental Capacity Act has been evaluating in accord with International flow, and there are implications for the Korea adult guardianship system.
