The purpose of this paper is to suggest that ‘mock trial’ has to be taught as a general education course in Korean colleges. As Korean democracy has been progressed, the jury trial system was introduced for the first time in Korean history seven years ago. However, education about jury trial system for citizen as well as students is in its infant stage. Within this context, this paper introduces contents and instruction methods of mock trial class at college level, based on ‘mock trial’ class opened at SungKyunKwan University for last five years as a general course. First, it compares and contrasts mock trial and moot court debate. Moot court has been practiced for several decades among the students majoring in law while mock trials has barely been introduced in Korean education until recently. This paper emphasizes the needs for implementing mock trial education in the Korean colleges not only to promote civic participation to jury system but also to improve student’s communication competency. This paper discusses details of teaching methods in mock trial class. First, it shows how to teach the origin of Greek forensic rhetoric in its relation to modern jury trial system, and how to teach the relationship among words, reality, and thoughts. Second, in order to help the students to understand the relationship between democracy and jury trial system, it presents how to teach the development of jury trial system of the U.S. and various modern European countries. Third, it investigates how to improve student’s logical reasoning and critical thinking in reading and analyzing mock trial scenarios and in preparing opening statement, examination, cross-examination, final statement. Fourth, it introduces a mock trial debate format, details of students activities in the class, and student evaluation. Finally, it argues mock trial class should be a basic course at college level in order to understand the jury system better.
