The purposes of this study were to investigate (1) the historical developments of sports contracts and (2) the elements of sports contracts negotiation in the United States The conclusions are as follows 1. The U. S. professional athletes has been enjoyed the fruits of increased bargaining power through rising of free agency and arbitration, collective bargaining by players associations, media exposure, increasing popularity of sports, and the advent of the agent. 2. For the contract with the club, adequate preparation includes evaluating the value of player`s services, evaluating the needs of the player, evaluating the needs of the club, knowing the opposition, being aware of the context, and providing the athlete with other necessary services, as well as a basic understanding of the negotiations process itself. 3. In negotiating and drafting the agreement between player and club, the parties can contract to the length of the contract, the signing bonus, the base salary, and the tax benefits attributable to various compensation packages with a standardized agreement. 4. After negotiation of the contract, the agent must protect the player`s interest under the contract, negotiate a contract during its term or prepare for subsequent free agency, arbitration, or negotiation with another club, and counsel the player about post career security.
