In 1986, Korea established a separate, single law called the computer program protection law to protect computer programs. Korea has such law, which is separate, and different from the copyright act even though such law protects computer programs based on the principle of the copyright act. The reason is that the computer programs, unlike the ordinary written works, are economic materials related to advanced technologies. Thus it is necessary to protect and foster them for the promotion of national economy by fostering the information and communication industry, and specially handle them to promote distribution, technology transfer and the quality assurance in addition to the protection of the program copyrights.
As the technical environment witnesses continuous changes, such as the rapid development of telecommunication technologies, appropriate measures are urgently needed to protect the new intellectual properties like the digital contents and software components, and to counter new type of technical infringement.
In addition, it is also necessary to protect the copyright holders' monopolistic and exclusive rights, guarantee access rights of the users and adjust diversified but sometimes conflicting profits dubbed the fostering of related industries.
(l) When we follow the pluralistic existing intellectual property rights protection law, different protection systems are applied to single software. This creates a problem that there are differences between each protection object in terms of the period and range of protection. Consistent law application and protective systems are required covering the entire software, and in connection with this, it is necessary to expand the range of protection (scope of law application) not only for the computer programs but also for the relevant materials.
(2) In order to see effective preventive measures against a new type of technical infringement and to guarantee the effectiveness of control, we need to diversify administrative means and establish laws governing the procedure of related disputes.
(3) In addition, we must adjust and relax the regulations governing the reverse analysis the access right of which is excessively restricted compared with other foreign countries, and measures to protect technologies.
