Ⅰ. Research objectives
The purpose of this research is to clarify the range, means and limits of protecting computer programs taking into consideration the distinctive characteristics of the existing intellectual property rights such as software and copyrights, and to seek desirable improvement directions from the balanced viewpoints called adjustment of understanding between the suppliers and the users by specifying the concept and the range of fair use and by guaranteeing such fair use.
Ⅱ. Expected effects
1. Acceptance of traditional principle of law covering fair use
2. Protection of the user's rights to use and personal rights
3. Promotion of joint creation of net-space
4. Contribution to the development of IT industry through the protection of use
5. Creation of an environment for the use of genuine products.
Ⅲ. Status of use protection
1. Relations between the computer program protection law and the copyright act
The computer program protection law in general is composed of a copyright protective system in the form of a special law of the copyright act, and the protection of use is merely an exceptional permission.
2. Major regulations and contents related to the computer program protection law
1) Purport of "fair use" as stipulated in Article 1 "Purpose"
2) Restive regulation governing the computer program
3) Reverse analysis of computer programs
4) Copying allowed when the copyright holder is unknown.

1. Non-existence of the regulation governing comprehensive use protection such as fair use.
2. Excessively long copyright protection period
3. Reverse function of the technical protection measure or the right management information
4. Technology development obstructed due to limitation on reverse analysis
5. Excessive computer program purchase expenses
6. Etc.

1. Documentation of fair use and the expansion of application range
2. Reduction of the copyright protection period
3. Seek ways of solving the reverse function of the technical protection
4. Expansion of the allowable range of reverse analysis
