This paper attempts to assess the optimal level of copyright protection for digital material such as electronically published books. To this end, this paper analyzes the current Copyright Act of Korea from the legal and economic viewpoints. This paper starts with an assumption that the basic purpose of Copyright Act is to harmonize rather contradicting interests simulating authors' willingness to create intellectual works and preventing under-utilization of copyrighted products due to overprotection. in other words, the optimal level of copyright protection is to make balance between the copyright owners who own the content and the distribution industries that disseminate the content to the public.
The current Copyright Act of Korea, which was recently modified to meet the newly emerging world i. e., digital environment, created transmission right & other legal protection devices in order to prevent illegal utilization of digitalized intellectual products. This is because that as the era of digital world has deepen, the Internet poses a new threat to copyright owners of e-book not merely because digital ones and zeros can be reproduced effortlessly and perfectly, but because the Internet is a network that allows for two-way communication.
The economic traits of e-book as an information goods are considered to interpret legal codes of the current Act properly. Landes' & Posner's arguments about optimal level of copyrighted material are also examined to see if their findings can be helpful to assess the appropriate protection level of copyrighted e-books. Elasticity of digital material and its expression cost seem to be crucial factors for the realistic interpretation of the Act. Both public value of e-book and its fair use seem be also useful to examine the optimal level of copyright protection.
Based on the legal and economic analysis of copyrighted digital material, the following policy suggestions have been made. First of all, it is recommended that various codes of Act be developed to prevent underproduction and underutilization of digital material. Strong implementation of contributory liability is also suggested to restrain various types of infringements of digital products. However, this paper stresses that any change in the copyright law that increases the copyright owner's control should be scrutinized carefully.
