This paper intends to provide the basic knowledge and database on the establishment process and the fundamental resources of the Treaty establishing a Constitution for Europe(“European Constitution”) signed by the Rome European Council on 29 October 2004 and the possibilities of its ratification.
The establishment of the European Constitution has been proceeded by three steps as follow;
It was the Nice European Council which has started to enact the European Constitutional Treaty. So this Council adopted “Declaration on the future of the Union”('Nice Declaration') annexed in the Treaty of Nice.
The second step was related to the “Convention on the Future of Europe”('European Convention') opened on 28th February, 2002 in Bruxelles. On the basis of the final reports submitted by eleven working groups, which has composed by the latter Convention, the European Council adopted “a draft Treaty establishing a Constitution for Europe:” on 18th June, 2003.
The signature of the European Constitution in Rome on 29th October, 2004 is concerning the final step of its establishment. The European Constitution should be ratified by all Member States because it was adopted in form of 'a treaty', but this process troubles some problems.
