Acting on the basis of chapter VII of the UN Charter, the Security Council adopted the Statute of the International Criminal Tribunal for the Former Yugoslavia(ICTY) which constituted an extremely important development of international humaniutarian law with regard to the criminal character of internal wars in the Former Yugoslavia. The offenses listed in Articles 2 and 3 of the Statute of ICTY(grave breaches of the Geneva Conventions and violations of the laws or customs of war) indicate that the Security Council considered the armed conflicts in Yugoslavia as international. Subject matter jurisdiction under the Statute of ICTY encompasses two principal offenses. First, the Statute grants the ICTY the power to prosecute persons who have committed genocide. Of course, the customary law character of the peremptory prohibitions stated in the Convention on the Prevention and Punishment of the Crime of genocide was affirmed long ago by the International Court of Justice. Second, the Statute confers on the ICTY the power to prosecute persons who have committed crimes against humanity. To prosecute crimes against humanity under Article 5 of the Statute, it is required to show only that the crimes listed in that article were 'directed' against any civilian population. Clearly, crimes against humanity overlap to a considerable extent with the crime of genocide. Indeed, the latter can be regarded as a species and particular progeny of the broader genus of crimes against humanity. Crimes against humanuty are crimes under customary law. genocide is a crime under both customary law and a treaty. Genocide requires evidence of 'intent' to destroy, in whole or in part, a national, ethnical, racial or religious group as such.
