As one contents of the equal treatment principle, the prohibition of discrimination for nationality should be applied to the collective industrial relations as well as the individual employment relationship.
The article 5 of the Labor Standards Act expressly prohibits
discriminating for nationality and notwithstanding that the article 9 of the Collective Industrial Relations Acts doesn't make the list of a prohibition of discrimination for nationality, the three labor rights should be undoubtedly secured to the migrant workers in view of the character of the three labor rights and International
Convents on Civil and Political Rights.
A matter of frequent occurrence connected with the equal treatment principle, that is legal problem of 'the industrial trainee system.' In comparison with the incipient stage of the introduction of the system, it is undeniable that the legal status of the migrant workers have been become improved. In parts, the labor laws have been applied to the migrant workers and the period of training employment that could be won the approval of workers have been extended. but so far the industrial trainee system has only many problems. In the participate government, the industrial trainee system has been becoming the subject of reformation and there is being a controversy between the related bodies on 'the entire introduction', 'the keeping introduction with the industrial trainee system' and 'the postponement of introduction' of the work permit system. From my point of view, the work permit system should be introduced because that is in accord with the constitution and the labor law but in a short time the keeping introduction with the industrial trainee system leaves much room for consideration.
What we would be the last to overlook is a that there are a number of an undocumented workers and this should be overcome for not only the undocumented workers themselves but also the normal
administration of the internal labor market.
In addition, because the increasement of a number is resulted from the internal industry's large independence on the undocumented workers and the failure of the government's policy the undocumented workers will obliged to be legalization.
But the policy of legalization should become the starting point to build the administration of the undocumented migrants. After legalization the undocumented migrants or a employers who are employed them will be punished in accordance with the terms of Immigration Control Act and have got to do Immigration Control more effectively.
