Korean democracy after democratization has gone through struggle with the severe pursuit of private interests and political alienation of the citizen. New theories are emerging to deal with these problematic phenomenon from both sides, i.e. conservatism and progressivism, which are based on a constitutional notion of ‘republicanism’. This paper aims to give new understanding on democracy as a constitutional principle by critically examining a theory of neo-republican democracy (hereinafter, the theory) and identifying its constitutional implication. The main idea of the theory is a contestatory influence to a constitutional order. It pursues ideal democracy not based on the consent of the people, but based on the people’s contestation on the government activity. This concept of democracy provides alternatives to theories such as interest group pluralism and communitarian participatory democracy. The principle of neo-republican democracy (hereinafter, the principle) recognizes that a key of democracy lies on ‘self-government people’, but it adds special value to ‘government for the people’ by mediating common good. The principle has a theoretical basis which could contribute materialization of a theory of sovereignty and democracy and surpass formal understanding of democracy by constructing a ‘deliberative’ participation system for realization of contestatory democracy and by requiring democratization in private sectors. Under the constitutional interpretation, the principle provides an opportunity for us to understand financial democracy as an operation principle ‘for the people’, surpassing ‘by representatives of thepeople’ and helps broadening understanding educational democracy and economic democracy by making a request for democratization in social territory. Moreover, it provides a theoretical basis for justification to citizens’ exercise of the contestatory influence against the state action such as the jury system. Through this article, it is expected to provide the complementary insights to limits of representative democracy including alienation of citizens’ political participation and negligence of private domination.
