Heum’heum Shinseo(欽欽新書) is one of Dasan Jeong Yak-yong(丁若鏞)’s most renowned achievements, along with Gyeongse Yupyo(經世遺表) and Mokmin Shimseo(牧民心書). Heum’heum Shinseo is composed of 30 volumes featuring 5 categories, which include ①three volumes of “Gyeongsa Yo’eui(經史要義, Collection of essential Confucian Court trial protocols cited from classical texts and history books),” ②5 volumes of “Bisang Jeoncho(批詳雋抄, Outstanding reports on murder cases filed by Chinese officials),” ③4 volumes of “Eui’yul Cha’rye(擬律差例, Various cases of legal procedures’ application),” ④15 volumes of “Sang’hyeong Chu’eui(祥刑追議, Criminal cases from King Jeongjo’s era),” and ⑤3 volumes of “Jeonbal Musa(剪跋蕪詞, Case records written by Dasan himself).”
Meanwhile, like Dasan’s other countless writings, exactly how and when Heum’heum Shinseo was compiled and published remains to be clarified. Thus sufficient understanding of the text is still to be achieved as well.
In this article, the compilation process of Heum’heum Shinseo is reexamined, in order to create a comprehensive reference that could benefit future studies of Dasan’s legal philosophy and would also lead to better understanding of Heum’heum Shinseo. First the structure and contents of Heum’heum Shinseo are reviewed, and then the nature of Sang’hyeong-go(祥刑考) -which Dasan consulted in his compilation of Heum’heum Shinseo- as well as a variety of handwritten drafts of Heum’heum Shinseo, is examined here as well. Jeong Yak-yong’s collaboration with his disciples are discussed in this article too.
The above examination of Dasan’s compilation of Heum’heum Shinseo -which was created by a group effort combining his and his students’ expertise like many other Dasan writings- revealed four distinctive phases. The first phase commenced with his beginning of preparation and ended when he completed three volumes of Myeong’cheong-rok(明淸錄) -all during his Gangjin exile- in 1808, without his students’ aid. The second phase seemingly began at the end of phase 1, and culminated with the 1818 completion of the “24-volume version” of Myeong’cheong-rok (the de-facto first draft of Heum’heum Shinseo), which he completed through collaboration with his students. Then the “30-volume version” of Heum’heum Shinseo (which we have today) was completed in 1819 at the end of phase 3, and was supplemented with a formal foreword in 1822, marking the end of phase 4, as well as the final completion of Heum’heum Shinseo.
