Numerous businesses have sprouted up across our country to help address the problem of drinking and driving. According to some survey, designated drivers transport their drivers around 500,000〜700,000 times in a day. Increasing the volume of designated driver transport raised various legal problem. Consequently, the legislation bill to regulate the designated driver business was submitted several times, but have failed to enactment. The author review the need to legislation and concerned case. This paper summarize the Japanese designated driver law enacted in 2003 and debating insurance contract cases on the insurance protection of victims and driver against to the personal designated driver or designated driver business. We can find many lessons from the Japanese experience. The author conclude that new legislation that including some extent of compulsory insurance was required.
