Restorative justice is a process in which all stakeholders involved in criminal cases, including offenders, victims, and community members, actively participate in the problem-solving process. Restorative justice is a form of response that seeks restoration and reintegration of victims, perpetrators, and communities.
In the twentieth century, social efforts to cope with domestic violence have followed two different paths, depending on whether they focus on child welfare or women ’s safety. Two paths, however, have relied heavily on legal discipline or punishment in order to deal with the problem of the family. Since it only relies on legal dispositions of all the problems that arise in the home, the problem of the family repeats a vicious cycle. In this situation, Restorative justice is emerging as the alternative method for solving domestic violence problem. It is important to notice that the effort to stop domestic violence is not a matter of criminal justice or social welfare but of family members who are stakeholders.
This paper reviewed the practices of restorative justice in Europe and explored the restorative justice programs applicable to domestic violence. As a result, it is expected that the practice of restorative justice focusing on the restoration of the relationships will play a greater role in solving the domestic violence. Examples of restorative practices in Europe showed that restorative justice practices can be applied in many stages from pre-trial to post-trial. The examples of European RJ show the possibility of implementing restorative justice practices in the field of domestic violence.
