The rigours of English Criminal Law which considered crimes against property as capital had fostered judicial devices of commuting death penalty, of which transportation came to be most important, particularly after the colonies to which the convicts can be shipped were secured. The alarming rate of crime in Georgian London, or what was regarded as such, led to the passing of the Transportation Act of 1718, which stipulated transportation as the first sentence to those convicted of larceny and other species of property offences, in certain knowledge that the convicts will be sent to the colonies of Virginia and Maryland. With the rebellion of the Thirteen Colonies, English convicts could no longer be shipped across the Atlantic. After resorting to tentative measures such as the hulks, the government finally decided to transport the convicts to "Botany Bay," soon renamed "Sydney Cove," out of which the colony of New South Wales grew. The condition of the convicts at New South Wales, though harsh, encouraged the industrious to be released by conditional or absolute pardon, so that their labour, and in some cases, their professional skill, made crucial contribution to the foundation of a new European colony in that part of the world.
