According to the OECD reports, regulatory reform is a cross-cutting theme for ASEAN economic integration and regulatory coherence, as well as for individual ASEAN member state’s structural and rule of law reforms. ASEAN countries recognize that the economic agenda must be premised on productivity-driven and inclusive growth, aided by good regulatory practice (GRP). Since 2014, the ASEAN-OECD GOOD REGULATORY PRACTICE NETWORK (GRPN) has been serving as a key platform to consolidate the OECD’s engagement with ASEAN on regulatory reform. The mission of GRPN is to assist ASEAN Member States in building and strengthening capacity for the implementation of good regulatory practice to assure high-quality regulation and regulatory coherence. GRPN will achieve this mission by fostering the exchange of good practice and mutual learning among policy makers in ASEAN Member States and OECD member countries. The regulatory reform and the good regulatory practice are developed in Korea, China, India, Indonesia, Japan, Vietnam. Regulatory policy is about achieving government’s objectives through the use of regulations, laws, and other instruments to deliver better economic and social outcomes and thus enhance the life of citizens and business. Asian countries have the same interest and aim to the economical and political achievement for their own country.

규제개혁정책은 근래 유럽이나 미국, 아시아의 거의 모든 국가에서 추진되고 있다. 특히 경제협력개발기구(OECD)나 아시아태평양경제협력체(APEC) 등의 지역 경제공동체에서는, 규제개혁에 많은 관심을 지니고 회원국의 규제개혁을 모니터하고 있으며, 규제개혁 모범국가의 사례 등을 소개하고 있다. 아시아 국가에 있어서 규제개혁(regulatory reform)은 아시아권역의 경제통합의 측면에서는 물론이고 개별 아시아 국가의 구조개혁과 법령의 개혁을 위해서도 중요하다는 점에 목표를 두고 추진되고 있다. ASEAN 회원국들은 경제계획이 생산성 향상과 성장을 목표로 하는 규범을 전제로 한다는 것을 인식하고 있으며, 효과적·효율적·일관성·유연성을 갖춘 규범을 공동체 차원에서 모색하고 있다. 법치주의(rule of law)를 제도적 기반으로 하는 국가에서는 국가정책이나 기업활동 등의 제도적 기반이 법령임은 물론이고, 국가정책과 기업활동을 제한하거나 금지하는 규제는 법령에 근거를 두는 것이기 때문에, 올바른 규제정책과 이를 반영하는 입법정책은 대단히 중요하다. OECD와 ASEAN이 규제개혁에 관심을 갖고 공동의 목표를 추구하는 것도 이러한 이유 때문이다. 그러나 동아시아 국가의 규제개혁정책은 그 발전단계가 매우 다양하다. 경제개방의 폭과 범위에 차이가 많을 뿐만 아니라, 민주주의 발전의 단계도 매우 상이하기 때문이다. 또한 동아시아 국가의 규제개혁정책에 관한 자료에의 접근성도 매우 제한적이기 때문에, OECD의 규제개혁정책에 관한 자료를 중심으로 이들 국가의 규제개혁정책을 검토하였다. 일본의 규제개혁정책은 모범적인 것으로 볼 수 있다. 특히 일본의 규제개혁정책은 아베노믹스와 긴밀히 연결되는 것으로 볼 수 있고, 정부가 주도하는 의원내각제의 입법절차적 특성 및 내각법제국을 통한 규제개혁정책의 입법적 반영 등을 일본 규제개혁정책의 특징으로 볼 수 있다. 중국의 경우에는 ‘의법치국’이라고 표현되는 법치국가적 전통은 아직 미비하지만, 강한 경제력과 사회주의적 효율성을 수단으로 하여 규제개혁정책과 이를 반영하는 입법정책을 추진하고 있는 특징을 볼 수 있다. 베트남과 인도 및 인도네시아의 규제개혁정책과 입법정책은 시장개방을 통한 경제성장에의 열망을 나타내주고 있다.
