In Roman Republic, ill-reputed persons who committed delict such as calumnia, theft, false delatores, injuria, stellionatus, usury, robbery, or lived as bestiari, actors, lenones were stigmatized as infamy. Infamis lost the political rights belonged to citizen. Infamy was a perpetual disqualification from all public rights. Before the Late Roman Empire, those limitations were not executed under the legal force, but as a kind of social common sense. The law of Constantine the Great codified to exclude infame from all offices and honors through his rescript.
The concept of Roman infamy was accepted in Christian councils of the fourth and fifth centuries for the purpose of protecting priests from the indictment of ill moral and subversive laymen. The inclination to protect priests from those was echoed in the collection of Pseudo-Isidor. The collector of this decretals related infamy to excommunication. Pseudo-Isidor strictly expressed all the excommunicates to be infame.
The conception of infamy in ancient councils accepted by Pseudo-Isidorian collection influenced on the decretal collections of 12th century. Roman source materials of infamy and canonical documents on it were inserted in the Decretum Gratiani. Decretists debated on the precise concept of infamy and its affect from these time on.
Infamy was sentenced by both secular and church judges. Whether infamy sentenced by secular court could be available in the church court was a critical issue among the decretists.
Even if Infamy had its origin in the Roman Republic, it was a significant jurisdictional element in the middle ages. Infamy seemed to be one of the essential disciplines to protect priests and keep the Christian community in order. From this point of view, it can be said that infamy was to be a substantial subject attracting the energetic discussions among the decretists in the middle ages.
