The purpose of this paper is to highlight certain issues regarding the burden of proof in Marine Insurance Contract and to provide alternatives in compliance with the principle of equality and fairness. The following are the suggested alternatives of the burden of proof.
Firstly, if perils of the sea or barratry competes with willful misconduct, it would be appropriate to put the burden of proof on the assured. In contrast, if fire competes with willful misconduct, it would be appropriate to put the burden of proof on the insurer.
Secondly, if the insurer insists on the assured' willful misconduct, the standard of proof on the insurer should be modified so that a prima facie evidence can be accepted based on previous experience and circumstantial evidence rather than direct evidence on intention.
Thirdly, in voyage policy, if there was a loss in an unexplained circumstance in good weather condition, the presumption of the unseaworthiness can be overturned if it is proved that the ship was seaworthy at the commencement of the voyage. However, in time policy, it would be insufficient to prove that a ship was seaworthy just before the loss. Namely, there should be sufficient evidence to rebut the presumption that the loss incurred due to an excluded risk.
Fourthly, in a missing ship, the accident should be presumed to be attributable to an unascertainable peril of the seas, if the assured can prove seaworthiness as well as adverse weather condition at the time and place where the accident was presumed to occur.
