The criminal mediation in Korea is assessed to have, in many aspects, affirmative effects but cannot be considered to be a perfect system. That is, it may raise the fear of a victim because she or he should face an offender and also mediators cannot resolve the imbalance of power between a victim and an offender. Also, it can invade the right to fair trial. Therefore, a criminal mediation should not be used for the mere diversion for an offender. we should find out the balancing point to support the fundamental principle for the basic paradigm of restorative justice in the criminal justice system in conflicting values.
We should find out the proper model in the incorporation of restorative justice paradigm into traditional criminal justice system. In the practical aspect, that kind of model may not sufficiently support the basic principle of restorative justice paradigm but would be still meaningful in that it can resolve the dispute that is hard to be dealt with in the traditional criminal justice system.
Now in Korea, since Jun 2007, the criminal mediation in the victim support service has been operated. The success of mediations comes more than 50% in the national level and is assessed positively for its effectiveness. Nonetheless, the criminal mediation has been operated for particular crimes without any statutory ground but pursuant to the guidance of the prosecutor's office and the guidance of the victim support service. The introduction of the criminal mediation does not come from the ideal of the restorative justice but start for the reason of the voluntary resolution of criminal dispute and the efficient function of the prosecutor's office.
The subject of the current criminal mediation is limited to the minor crimes. Also, because a victim support service which works as mediation institute is closely related to the prosecutor's office, there is a question of neutrality. Moreover, it often happens that a mediator does not get sufficient information of cases. In addition, the issue of restoration of relationship of parties is not dealt with so well because mediators has worked so excessively to achieve agreement of parties.
For the better practice of criminal mediation, we should focus on the voluntary operation of mediation by parties, rather than the growth of simple results of agreements. It should be noted that the core ideal of criminal mediation is not in the reparation of damages but in the restoration of relationship of parties.
To incorporate the value and philosophy of restorative justice into the criminal justice system, it must be desirable to reform many problems of criminal mediation and also take as many criminal cases as possible to the criminal mediation. In this sense, we should consider the mandatory mediation system for an offender, even though an offender does not volunteer to mediation. This mandatory mediation may work in relation to suspension of indictment, probation and suspended sentence. It would rather legislate a mediation system in which the conditional suspended prosecution not to violate the presumption of innocence. Also, with the condition of serious efforts for mediation, a new type of probation can be considered. Nonetheless, the conditional probation system should not be legislated if it has a mandatory means. If the voluntariness cannot be the precondition of mediation, the ideal of mediation will be far from the place of true realization.
