This study examines the new establishment of Korea Communications Commission (KCC) and its influence over broadcasting, focusing on its legal aspects. While discussing KCC and its role on broadcasting, this study also investigates a possible regulation system over broadcasting for better publicity and public interest. KCC has been established under the office of the President since February 29, 2008, after consolidating the former Ministry of Information and Communication (MIC) and the Korean Broadcasting Commission (KBC). By establishing KCC, the government tries to organize broadcasting and telecommunications sector under a unified umbrella, to promote the convergence process between broadcasting and telecommunications, and to lesson overlapping government regulations. It is also arguable, however, that the founding of KCC may make broadcasting open to competition and commercial efficiency. The former KBC, an old regulation agency, was not supervised by the office of the President. Because KCC is an organization which is ultimately supervised by the office of the President, it is literally undeniable that the government can exert influence on the organization that operates diverse regulations broadcasting sectors, whether directly or indirectly. Recognizing this aspect, this study stars from an idea that it is possible for KCC to diminish Public Service Broadcasting (PSB).

〈방송통신위원회〉는 대통령 소속의 행정기구로 설치되었다. 이로써 방송과 통신의 융합곡면을 원활하게 진흥하고 규제ㆍ감독할 수 있게 되었지만 방송의 자유를 보장받기는 어려운 구조가 되었다.
방송은 언론의 자유를 구가하는 사회적 제도다. 언론의 자유는 민주주의의 근간이다. 이러한 점에서 우리 헌법도 언론의 자유를 보장하고 있다. 방송의 자유는 정부 권력으로부터의 독립에서 비롯된다. 그리고 편성과 재원조달의 자율성으로 완성된다. 그러나 대통령 직속으로 설치된 〈방송통신위원회〉는 대통령과 국무총리의 행정감독권이 영향 미친다는 점에서 정부 권력으로부터의 독립은 물론 편성과 재원조달의 자율성도 보장받기 어렵다. 애초에 방송통신 산업의 진흥을 위해 고안된 대통령 직속의 〈방송통신위원회〉 모델이 정권 전환기에 별다른 사회적 논의없이 결정되어버린 결과다.
〈방송통신위원회〉가 행사하는 방송 규제 내용은 방송사 경영진의 인사는 물론 프로그램 제작, 방송사 허가ㆍ재허가, 경영평가, 편성, 재원의 문제에 이르기까지 방대하다. 법리적으로 〈방송통신위원회〉가 대통령 직속으로 설치됨으로 써 정부권력으로부터 방송의 자유가 위협받고 있다는 주장이 가능하게 된다.
방송은 공공적이고 공익적인 기능을 수행한다. 상업적 행위를 하는 방송사라 하더라도 공공성과 공익성은 피할 수 없는 사회적 책무다. 이러한 공공성과 공익성은 경쟁과 효율성을 기치로 하는 산업적 시각으로 규제할 수 없다. 마땅히 사회문화적 시각에서 규제되어야 한다. <방송통신위원회〉가 경쟁과 효율성을 강조하는 상업적 규제틀을 천명하는 것은 방송의 공공적이고 공익 적인 기능을 위축시키는 것이다.
본 연구에서는 대통령 소속의 행정기구로 설치된 〈방송통신위원회〉가 어떤 법리적 문제가 있는지, 그리고 공공성과 공익성을 강조해로 방송을 규제하기 위해서는 어떠한 규제틀이 필요한가를 살펴보았다.
