An important theme in modern society expresses a profound concern about the rise of community opposition for “disgusting facilities” like land-fill sites. Those most deeply worried about this issue perceive substantial damages of property, health, and amenity. A certain irony attends this theme, because residents usually admit that land-fill sites are necessary, but not near their homes. Hence. it is so popular to use the term “not in my backyard”. NIMBY sentiments can have a devastating impact on the provision of land-fill sites, leading to the withdrawal of needed projects or to the closure of an existing facility.
The purpose of this study is to examine the conditions of land-fill sites, to analyze the problems in securing processes of land-fill sites, to explore alternative approaches to a fair compensation or a fair share principle, and then to clarify the role of local assembly in the fair compensation processes of land-fill sites.
It is common that neighborhoods and political leaders are fighting with increased fervor to prevent unpopular projects from being sited in or near their communities. Particularly, most of our land-fill sites have been criticized by open dumping, unsanitary land-fill, and poor management techniques.
The results of the analysis are as follows: (ⅰ) it is urgent to keep a steady supply of land-fill sites under existing circumstances; (ⅱ) opposition arguments. after the initial angry phase, usually express three specific concerns: the perceived threat to property values. personal security, and neighborhood amenity; (ⅲ) the fair distribution of the burdens and benefits is essential to make a collaboration between the agency and the host community. Even though fair share would not be an instant panacea, the balance of the burdens and benefits could be approached on fair share criteria. particularly in compensation for a loss of property; (ⅳ) it is possible to filter out the problems of the fair distribution of the burdens and benefits by political processes. In those processes, local assembly can take the initiative in securing a steady supply of land-fill sites based upon fair share criteria; and (ⅴ) the positive role of local assembly has not fixed in the fair compensation processes of land-fill sites. It is mainly due to the intrinsic limitation of local assembly and the lack of self-consciousness for the roles of local assembly men.
