Peer-to-Peer File Sharing Systems provide a revolutionary means for copyright infringers to achieve their tasks. In A&M Records v. Napster, Inc., the United States Court of Appeals for the Ninth Circuit agreed with the district court that the record companies presented a prima facie case of direct copyright infringement by Napster users. The panel upheld the district court's conclusion that Napster may be secondarily liable for the direct copyright infringement under two doctrines: contributory copyright infringement and vicarious copyright infringement. The panel concluded, however, that Napster's duty to remove material from the server is triggered upon notice by the plaintiffs of copyrighted works and files available on the Napster system.
In MGM v. Grokster, Inc., the United States District Court found that plaintiffs established direct infringement of their copyrighted works by some users of defendants' software. But the judge found that defendants were not to be held liable under the precedent established by the Napster case.
Napster's system is a centralized P2P network, which relies on a central server. Soribada's system's too. The District Court found that Soribada users were engaged in direct copyright infringement of plaintiffs' copyrighted works. The panel found that Soribada was engaged in contributory infringement because Soribada had knowledge of its users' infringing activity, and materially contributed to the infringing activity. I think that the scope of the district court's injunction was overbroad.
