The commercial advertisement delivered to email users whether they want or not are called the spam mails. These spam mails cause a lot of problems so that each country regulate them. The characteristics of the spam mail regulations of America try to accept that the spam mails are one example of freedom of commercial expressions but to minimize the damages caused by these spam mails. ED does not prohibit commercial email that the users do not want, but allows the personal users to acknowledge that they prevent those e-mail. The seriousness of those e-mail is also raised in Japan so that Japan established the laws on regulating the transmission of specific e-mail.
Meanwhile, Korea regulates the spam mails through the 'regulations for promoting telecommunication network and protecting information' in terms of legal systems. In addition, the users can demand the compensation against the illegal acts on the basis of Article 7fIJ of the Civil Law in terms of the civil cases and those who send spam mails are punished on the charge of interference of computer business and of property damages in terms of criminal cases. Online service providers autonomously regulate the services as applying the provisions to each user on the basis of the legal regulations.
However, these regulations are not satisfactory so that they shall be continuously supplemented. In addition, it also requires the self-regulation that is one of several regulations to cope with the quick technological changes of Internet, reports of Netizen related to spam mails and positive efforts of relevant organizations to root out those spam mails.
