Disputes, large and small, can easily arise in transaction relationships between businesses. In addition to non-performance of contract such as the seller's liability for defects and delay in product delivery, the dispute mediation system can be used if the actions of one party constitute a violation of fair trade laws. Dispute mediation is a system in which the parties directly participate and autonomously resolve the dispute and receive compensation for damages. On August 21, 2024, the enactment of the “Act on Mediation of, Disputes Related to Fair Trade (‘Fair Trade Dispute Mediation Act’)” was proposed. This enactment is intended to integrate dispute resolution-related regulations scattered across a total of six laws, including the Fair Trade Act, Franchise Business Act, Subcontracting Act, Large-Scale Distribution Business Act, Terms and Conditions Act, and Agency Transactions Act and to comprehensively overhaul and improve the current dispute resolution system. In the field of fair trade, there is a legal basis for establishing a local government dispute mediation committee regarding franchise business and agency transactions. Local government dispute resolution committees should also be activated through the Fair Trade Dispute Resolution Act. in some laws, the reason that the authority to establish dispute mediation committees was shared with local governments is it was highlighted that franchise operators and dealer operators are important policy beneficiaries as small business owners of local governments. It is the result of the efforts of local governments to localize fair trade, in the metropolitan area since 2015, solidarity among the metropolitan area, and cooperation with the Fair Trade Commission. Local dispute resolution committees are achieving certain results in resolving disputes in franchise business transactions. This study examined issues of jurisdiction, expansion into other fair trade fields , and issues for revitalizing collective dispute mediation and sought solutions to revitalize local government dispute mediation committees through the Fair Trade Dispute Mediation Act.

사업자 간 거래관계에서는 크고 작은 분쟁이 발생하기 쉽다. 매도인의 하자담보책임, 상품인도 지연과 같은 채무불이행 분쟁 이외에도 일방의 행위가 공정거래 관련 법률 위반행위에 해당하는 경우, 다양한 해결방법 중 공정거래분야 분쟁조정제도를 활용할 수 있다. 분쟁조정은 당사자가 직접 참여하고, 자율적 의사로 분쟁을 종결하여 피해를 배상받는 제도이다. 현재 공정거래법, 하도급법, 가맹사업법, 대규모유통업법, 대리점법, 약관법에서 분쟁조정제도를 각각 규정하고 있다. 그러나 개별법에 포함되어 있어 절차상 통일적 운영이 되지 못하고, 법개정도 각각 진행해야 하는 어려움이 있었다. 6개 분쟁조정제도 관련 규정을 통합하고 재정비한 공정거래분쟁조정법의 제정의 필요성이 제기되었고, 2024년 8월 21일 공정거래위원회가 국회에 공정거래분쟁조정 통합법률안이 제출하였다. 그러나 단순히 제도를 통합하는 데에 그칠 것이 아니라, 기존 공정거래 관련 분쟁해결제도의 실효성을 제고하고 더욱 활성화할 수 있도록 제정법이 마련되어야 할 것이다. 시·도 분쟁조정위원회의 설치·운영권한이 광역지자체에 공유된 것은 가맹점사업자와 대리점 사업자가 지자체의 소상공인으로서 중요한 정책대상이 된다는 점이 부각 되었고, 2015년부터 이어진 수도권지역 광역지자체의 공정거래의 지방화를 위한 정책추진, 수도권지역 지자체 간의 연대, 공정거래위원회와의 협력의 결과이다. 시도 분쟁조정위원회는 가맹사업거래 분쟁조정에 있어 일정 성과를 거두고 있다. 또 일부 지자체에서는 자율분쟁조정의 형태로 공정거래 전분야의 분쟁을 조정하고 있다. 공정거래 분쟁조정제도를 논함이 있어서 시‧도 분쟁조정 활성화에 대한 고려는 학계에서도 찾아보기 어렵다. 그러나 지자체는 지역 내 사업자들과 밀접한 관계가 있고, 분쟁조정제도 이용의 접근성도 높기 때문에 제도 활성화를 위하여 적극 활용할 필요가 있다. 이러한 시각에서 본 논문에서는 시‧도 분쟁조정협의회의 운영 현황과 관할권의 문제, 집단분쟁조정제도 활성화를 위한 실무상 쟁점, 타 공정거래분야로의 분쟁조정확대 문제를 지적하고 개선방안을 모색하였다.
