While the discussions on South Korea’s so-called ‘FMS-status’ emerged in the mid-2000s, bringing attention to the US’s preferential country groupings in the Foreign Military Sales (FMS) and granting of varying levels of administrative exemptions to its allies and partner countries, this article finds that the existing literature often omits a comprehensive outline of the US’s FMS system per se, as well as precise references to which such disparate treatment and country groupings can be observed. The main purpose here is, on the one hand, therefore mostly descriptive, in the aspiration that the article can serve as an accessible reference, mapping out the US’s FMS system, definitions, and references to key legislations and amendments that stipulated varying conditions for South Korea and other allies in their FMS transactions with the US. In the latter section, the article deliberates on the question of actual significance of South Korea’s FMS status-upgrade in 2008 in adjusting the recipient-supplier relations with the US. Juxtaposed to Israel, whose FMS status-upgrade came later in 2010, this articles argues that despite historical and legislative merits of status-upgrade, the changes remain peripheral to enhancements in administrative and circumscribed conditions in arms transactions with the US, requiring for more follow-up measures to make the momentum a new turning point in adjusting South Korea’s recipient autonomy beyond mere status-upgrade in the US’s FMS system.
