I want to put emphasis on the importance of the audit & inspection system in local government for the legitimacy, validity, fairness and transparency of local administration and the development of modern local self-governing system.
In Korea, however, there have been some problems in the audit & inspection system in local government such like the inadequacy or the surplus of the audit & inspection. The former has derived from the incomplete legal system of local audit & inspection and the latter from the overlap of many diverse external audit & inspections.
This article focuses on the following three issues in order to present the advisable legal model of local autonomous audit & inspection.
Foremost, this article takes a look at the internal audit & inspection(such as self-authority audit & inspection, audit & inspection by local assembly) and the external audit & inspection(such as audit & inspection by central government and it"s orgals, National Assembly and the Korean Board of Audit and Inspection) and their legal bases.
Secondly, the system of the audit committee has been taken into account as the autonomous audit & inspection system in local government. I considered and compared the audit committee of Jeju and Seoul and their legal system by and large.
Lastly, it is meaningful to go over the Japanese legal system of the local audit & inspection.
In conclusion, I presented the legal model of local autonomous audit & inspection which has the independent and specialized audit committee in the respect of legislative policy.

현대 지방자치의 안정적 착근(着根)과 지속적인 발전의 담보수단으로서, 지방행정의 적법성, 타당성, 공정성, 효율성, 투명성 등을 검증하고 지방공무원이나 공무종사자들의 부정과 비리를 제거하기 위한, 지방자치의 ‘감사(監査)’의 문제를 중시하지 않을 수 없다.
그런데, 그동안 우리나라의 지방자치단체의 감사에 대하여는 감사의 부실과 감사의 과잉 등이 문제되어 왔다. 전자는 불완전한 자치감사법제, 체계적이고 전문적이지 못한 감사실정에서 비롯된 것이고, 후자는 지방자치단체 내외의 다수의 기관에 의한 과다 · 중복 감사 등으로 인해 지방행정 본연의 업무 수행에 차질이 초래된 데서 지적된 문제이다. 이에, 제대로 된 지방자치감사제도의 확립과 운영이 현 지방자치와 지방행정의 안정과 발전에 매우 긴요하다는 관점에서, 감사를 둘러싼 위와 같은 문제들을 시급히 개선하여야 할 국가적 · 지역적 과제로 판단하였다.
이와 관련하여, 먼저 본 논문에서는 현행 지방감사체계를 내부감사와 외부감사로 나누어 개관하고 그 각각의 근거법제를 살펴보았으며, 특히 내부감사로서의 자체감사제도의 현황과 문제점, 자체감사의 발전형으로서 제주 등의 감사위원회제도를 면밀히 고찰하였다. 이어 비교법적으로 감사위원제도와 계약에 의한 외부감사제도를 중심으로 하는 일본의 지방감사제도도 검토하였다. 이러한 연구검토를 거쳐서, 입법정책적 관점에서 우리나라 자체감사제도의 법제개선모델을 제시하였다. 새로운 자체감사 모델은 현대적인 적극적 성과감사형으로 그 역할과 기능을 전환하고 독립적이고 전문적인 자체감사체제로 개편되는 것이 바람직하다고 보았고, 핵심적으로 조직(직제)과 인사, 직무와 예산 등에서 실질적인 독립성을 확보한 합의제 감사위원회제도를 전면 도입할 것을 제언하였다.
그리고 내부감사에 이어서, 중앙정부(정부합동감사, 소관부처 개별감사), 국회, 감사원 등의 국가기관에 의한 지방자치단체 외부감사제도를 살펴보고, 그동안의 여러 법률적 쟁점 등을 검토하여 보았으며, 부분적으로는 일정한 제도 개선방향을 제시하였다.
지방행정의 적법성 · 효율성 · 책임성을 담보할 수 있는 이러한 지방자치감사법제의 개선과 효율적이고 체계적인 국가감사체계의 정립을 통하여, 주민의 권익보호와 지방자치단체의 자치권 보장, 나아가 지방자치제도의 획기적 발전에 기여할 수 있기를 기대해 본다.
