(1) Laws and policies related with employment might be a subject of disputes with regard to 'deregulation', in which 'the dismissal system' could be included. Especially, four managerial dismissal requirements which were established and legislated following judicial precedents are criticised as hindering the enhancement of the flexibility in labour markets and being an obstacle to new hiring, mainly youth employment in the light of 'Law and Economics'.
(2) Managerial dismissal which was legally admitted to Korea has brought a far-reaching and considerable influence to the national economy and society. In this regards, "the Social Safety Net" should be enlarged to support the living stability and promote reemployment of the unemployed as an ex-post-facto relief step. As regards the scope of managerial dismissal, a strict limitation can infringe employers' freedom of economic activity. Temporarily, it can contribute to the employment stability of the employed, but in the long run, deprive more workers of employment opportunities. In, the other hand, excessive extension of the scope can result in infringement of workers' rights to labour and life. Companies might get to seek more profit while employees should suffer unstable employment.
(3) It would be difficult to mark the balancing point between employers' freedom of economic activity and workers' rights to labour and life when devising legislation with the view of deregulation.
(4) Difficulty in harmonising 'Justice', the objective of law, and 'Efficiency', that of economics, explains the limits of legislation of deregulation laws. We live in the world where individualism is prevalent and it is also expected to spread over future society. It should be also considered that a rough-and-ready legislation inconsistent with reality of the market mechanism aggravates illegal and unlawful markets and with loss of effective obligation of contracts, it brings into disorder in labour markets of regular and irregular workers.
(5) This paper focuses on the limits that criticism of defects in dismissal-related policies does not have enough persuasiveness to deny theoretical and practical aspects of the dismissal system, through sub chapters about 'the system of dismissal and increasing the flexibility of labour markets(Ⅱ)', 'the system of dismissal and policy abuse(Ⅲ)', 'justification of the dismissal system(Ⅳ)', and 'prospects of society(Ⅴ)'.
(6) Confrontation in discussion comes from different opinions on our society and this paper simply suggested herein new perspectives about this discussion. The dismissal system, which requires further examination to overcome the limits and find an alternative to this system will be left for the subject of future studies.
