This article discusses the Article 69 of MIA that provide where the ship has not been repaired, the assured is entitled to be indemnified for the reasonable depreciation arising from the unrepaired damge.
MIA does not state how such reasonable depreciation is to be measured. So the legal position is not yet established in English law for reasonable depreciation.
The problems are now resolved, under ITC Hulls(l983), by simply treating the difference between the sound market value and damaged value of the vessel as the measure of her depreciation, ignoring her insured value altogether except in cases where the depreciation would be greater than the insured value.
But this clauses must be inserted in insurance policy.
