Taking into consideration the transitional character of the public system of Russia. the main goal of this work is to carry out a legal study of the dynamics of changes taking place in one of the most important fields such as private property institute. Yet another one is try to analyze the results of such transition. using the systemic approach and the historical background of private property concept. In contrast to the existing studies on the formation of market economy in Russia. which in majority use the quantitative aspect and economic method of analysis. the present study employs the legal components of transition process. In our mind. such an approach gives much wider perspective on understanding the core of the process and provides deeper analysis of foundation of market principles in Russia.
The author has an intention to look through the several controversial questions concerning the issue of general understanding of the concept in general as well as existing legal regulation of the private property issues at the moment and in our mind, the concept itself serves a principal role in successful transition of the economy into market regulated one.
While accomplishing this goal the issues of private property concerning land will be used as the principal object of study. and such a study will be based upon the existing discussions in academic circles as well as the chronology of development of understanding of concept of private property, reflected in history of Russia.
