This article examines the criteria for computing administrative fines to be imposed on the illegal activities including handset subsidies under the Telecommunications Business Act of Korea. In addition, this study explores on some points from which the problems of the current systems come, thereby suggesting methods for improvement. With a recent adoption of new guidelines applicable only to handset subsidies, the administrative fine systems are divided into two categories: one for handset subsidies and one for illegal activities other than handset subsidies. Even though both systems take step by step approach starting from the basic administrative fine which is used to determine and adjust administrative fines, the latter still employs so-called reverse diminishing rate system which should be lifted for its lack of any reasonable ground. On the contrary, the former principally introduces the method based on relevant turnover that is expected to enable optimal level of administrative fines as a deterrent. However, the first case applying the new method seems to fail to establish an appropriate level of deterrence due to the nature of administrative expediency of the new method. Therefore, it is suggested that administrative fines should be calculated in a way to become proportionate to the substance and extent of violation by enhancing relevance of the turnover with the violation and deliberating consideration factors.
