The approach to the idea of administrative act has two research courses. One is the method to research what to be administration, or what to be administrative action. And the other one is the method to research what is the object of administrative suit for people's interests. The former is found in the continental legal system of the time-honored tradition, and the latter is found in the United States in which the administrative law is made relatively new. In this, I intend to see the ideas of administrative laws in France and U.S. because these have researched relatively not much.
In France, the idea of ‘acte adrnnistratif’ has ‘decision administratif’ and ‘contrat administratif’. The former has the narrow sense of administrative act and the lawmaking acts, and is the object of ‘recour por exces de pouvoir’, but the latter is the object of ‘recour pour plein contentieux ou de plein juridiction’. The ‘decision administratif’ has ‘actes non relementares’ (actes individuels, actes collectifs, actes particuliers), lawmaking doings (‘reglements autonomes’, ‘ordonnance’…) and etc.
The ideas administrative acs in U.S. is not same as those in France. In U.S., there are not the systemic explanation of the ideas in administrative acts, differ from those in Korea. Lately the system of administrative law has founded, the legal terms has appeared such as ‘adm inistrative act’, ‘administrative action’, ‘administrative activities’, and ‘adm inistrative decision’ .. etc. In Korea, as to the ideal category of administrative acts, are drawn the important matters of lawmaking, administrative contracts, strengthening administrative court and administrative procedure.
