Recently as the social attention has been more increased in environmental rights, cases of conflicts on personal freedom in building permits and environmental rights of the neighborhood residents happen to be the more frequent. But in these suits Courts have made few amicable solutions. It seems to be resulted from the principle of the conventional interpretation and execution of building permits and immature environmental preservation policy decisions and mistakes in the planing level.
In the paper, I try to analyze the principle of the conventional interpretation and execution of building permits, to emphasize the function of mediation of interests between private ones or public, and to research relief methods of the neighborhood residents in the public and private law.
On the point of priority of environmental rights, I stress the neighborhood lawsuit as the litigation by the interested third one and expanding the recognition-scope of qualification of the plaintiff in the right claiming administrative intervention. And also I try to emphasize the limits of relief after the fact founded upon the irreversibility and wide-ranging of environmental disturbance. I assert the importance of regulation by adjective law as a controlled means before the fact and the completion of legislative management.
Finally it should be supposed that the revised one of the code of administrative procedure should be carried into effect as soon as possible, which has been prepared for solving those problems.
