The International community has begun to combat against the abusing acts of paedophilia on the internet. UNESCO has sought to fulfill its ethical mission by helping to prevent the perverse and vicious abuse of the most fundamental rights of the child. Its main task is to combat against “child pornography” through the various legal instruments.
The question of what constitutes child pornography is complex. The standards applied are often subjective and contingent upon moral, cultural, social situation and religious beliefs. Furthermore, these standards do not translate into law in the strictly judicial sense. Legal definitions of both children and child pornography may differ globally.
The 1996 Stockholm World Congress against the Commercial Sexual Exploitation of Children defined child pornography as ‘any visual or audio material which uses children in a sexual context. It consists of the visual depiction of a child engaged in explicit sexual conduct, real or simulated, or the lewd exhibition of the genitals intended for the sexual gratification of the user, and involves the production, distribution and/or use of such material’.
Some researches reported that child pornography was usually used in the sexual crimes, especially child sexual abuse. Such pornographical material is used in different ways. Some perpetrators use it to coerce children into submission, others to legitimise the act so that they see it as acceptable behaviour, and a third group uses pornographic material in self-stimulation preceding sexual abuse.
Children that are exploited in child pornography are automatically exposed to abuse, as it depicts the sexual acts of child. The child pornography normally depict explicit sexual activities in the form of physical contact, masturbation, adult and child sex, and sex between children. In addition children exploited are found to come from underprivileged homes, lacking in child care. This also means that children coming from underprivileged circumstances are vulnerable to becoming economically dependent, selling their bodies for sex and pornography.
Children abused in child pornography usually suffer from the serious traumas coming from sexual abuses Internationally, clinics and researchers agree that there are three factors that are decisive in determining how serious a trauma may be expected in a child exposed to sexual abuse. These factors are the nature of the abuse, the length of time that the abuse has occurred, and perpetrator/child relationship.
So it is very urgent that legal resources is to mobilised for combat against the child pornography nationally and globally. “Protection of the Juvenile’s Sex Act” provides the punishment for the crimes of various sexual abuses of children and juveniles. The Act also prohibits the production and distribution of child pornographic materials. 'Juvenile Protection Act" also prohibits the uses and abuses of the juvenile for the commercial profits and provides the penalties for the exhibition of the pornographic materials to juveniles.
There are no provisions which punishes the possession of the child pornography for the purpose of seducing the child to engage into sexual acts. However, paedophiles often uses the pornographic materials for such purposes. So the provisions which prohibits the possession of child pornographic material for seducing the child is needed to be enacted. Also the organizations for the victims of child abuse is needed to be established for the rehabilitation of child sexual abuse victims and supporting the parents of child victims.
