With regard to the plight of suffering children, as a result of the global economic crisis and worsening financial difficulties that have occurred recently in South Korea, maltreatment in the form of negligence, such as failure to provide sufficient food, clothing or shelter, the very basic requirements needed by children, has increased significantly, which has allowed the phenomena of child abuse to become more apparent. Child abuse impedes the physical and mental development of children. It is a primary cause for the collapse of families and is likely to be connected with a violent crime.
To effectively deal with the issues of child abuse, the defect of child welfare law and its reform plan should be discussed while focusing on the clause relating to child abuse among the provisions of current child welfare law, placing the benefits for children as a top priority and uniquely stipulating the problems of child abuse. To improve the effectiveness of these child laws and to secure the ‘right to be protected’, revision of law concerning concrete principles and the system of child welfare law, the most fundamental of laws, should be executed urgently.
Above all else, in discussing the limitation of child welfare law and its alternatives, modification of the law shall include the measures that are most effective, giving actual help to children and families suffering from child abuse.
