Constitution of the United States proscribes impeachment system for President and other officials. Art. 11, Sec. 4 of it says: "The President, Vice President and all Civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors." The grounds for impeachments are "treason, bribery, or other high crimes and misdemeanors". Here, the term 'treason' or 'bribery' can be reasonably defined. But 'other high crimes and misdemeanors' is a very abstract term. The fact that 'misdemeanor' here is not just a criminal law term which is usually compared with 'felony' adds the difficulty in interpreting it.
This article searches for the meaning of 'other high crimes and misdemeanors', especially in case of the impeachment of the President, from a historical perspective. First, it reviews the creation and usage of the same term in England. Second. it chases the track the forefathers of the Constitution followed in enacting the term to the Constitution. Third. it introduces the views of several contemporary scholars regarding the term. Finally, based on the findings from above, it suggests a standard by which we can reasonably interpret the term in any impeachment case of the President. The standard consists of mainly two considering factors: the president as a representative organ like Congress and the separation of powers. Through this standard, we can decide whether a President's violation of the 'other high crimes and misdemeanor' clause would reach to an impeachable level or not.
